At the same time, the Shanghai Procuratorate issued a white paper specifically on the conduct of public interest litigation in the fields of ecological environment and resource protection for the first time.
From 2018 to 2023, the city's procuratorate filed and handled a total of 6183 public interest litigation cases in the field of ecological environment and resource protection, including 5329 administrative public interest litigation cases and 854 civil public interest litigation cases, and 312 lawsuits were filed with the people's courts. Nearly 95% of the cases The purpose of ecological restoration was achieved before litigation, and 23 ecological environment and resource protection cases were rated as typical cases and excellent cases of public interest litigation by the Supreme People's Procuratorate and the Supreme People's Court.
The white paper mentioned that the above-mentioned public interest litigation cases involve not only traditional environmental pollution issues such as the atmosphere, water, and soil, but also new types of cases such as carbon emissions, alien species invasion, biodiversity protection, and light pollution. In order to improve the professional level of case handling, procuratorial organs have strengthened the application of big data and built a big data legal supervision model. Nine public interest litigation rapid detection laboratories have been built, equipped with professional equipment such as rapid inspection boxes, drones, and laser rangefinders, and use technologies such as blockchain, satellite remote sensing, and 3D modeling to provide technical support for case handling.
In addition, the procuratorate practices the whole process of people's democracy in handling cases, strengthens the publicity of the rule of law, guides the public to participate in public interest litigation, builds social consensus on protecting the ecological environment, and forms a synergy between the rule of law in ecological governance.
As early as 2020, the Municipal Procuratorate signed meeting minutes with the Municipal Ecological Environment Bureau to further strengthen coordination and cooperation in the transfer of clues, investigation and verification, consultation, filing of litigation, ecological restoration, etc. of ecological and environmental damage cases, and promote ecological and environmental damage compensation and procuratorial public interest litigation. Effective connection. From 2020 to 2023, the city has handled more than 230 ecological and environmental damage compensation cases, involving compensation amounts exceeding 500 million yuan. This year, 18 units including the Municipal Ecological Environment Bureau and the Municipal Procuratorate jointly issued the "Detailed Rules for the Implementation of Compensation for Ecological and Environmental Damage in Shanghai City" to further strengthen the connection model and promote mutual support and complementarity between ecological and environmental damage compensation and procuratorial public interest litigation.
