Ministry of Justice: Last year, administrative review agencies accepted 2764 new cases in the field of ecological environment

At present, my country's economic and social development has entered a stage of high-quality development that accelerates greening and low-carbon. Using judicial means to protect the comprehensive green transformation of economic and social development has also become one of the important tasks of the judicial organs. Since last year, focusing on promoting high-quality development, the Ministry of Justice has formulated and revised administrative regulations such as the Ecological Protection Compensation Regulations, the Interim Regulations on the Management of Carbon Emissions Trading, and the Regulations on the Management of Ozone Depleting Substances to improve the system and mechanism for implementing the concept of "lucid waters and lush mountains are invaluable assets".

"Focusing on establishing and improving the ecological protection compensation mechanism, we have worked with the National Development and Reform Commission and other departments to formulate and promulgate the" Ecological Protection Compensation Regulations ", implement the decisions and arrangements of the Party Central Committee and the State Council on ecological protection compensation, and implement it in practice by various regions and departments. The experience and practices have been consolidated and expanded in the form of comprehensive and basic administrative regulations, and the basic institutional rules for ecological protection compensation have been established." In addition, the Ministry of Justice has also thoroughly implemented the deployment requirements of the Third Plenary Session of the 20th Central Committee of the Communist Party of China on improving the basic system of ecological civilization, and worked with relevant parties to draft the "National Parks Law (Draft)" and "Farmland Protection and Quality Improvement Law (Draft)" and other laws and regulations to promote the construction of a natural reserve system with national parks as the main body and improve the construction of high-standard farmland. At the same time, we will implement the requirements for environmental risk management and control, and work with the Ministry of Ecology and Environment to revise and promulgate the "Regulations on the Management of Ozone Depleting Substances" to further improve relevant regulatory measures. In addition, the Ministry of Justice, together with the Ministry of Ecology and Environment, formulated and promulgated the "Interim Regulations on the Management of Carbon Emissions Trading" to clarify the national regulatory system for carbon emissions trading and related activities, and build a basic institutional framework for national carbon emissions trading.

To promote high-quality development, we must bring government actions at all levels into the track of the rule of law. The Ministry of Justice has always placed in-depth promotion of administration according to law in an important position. In terms of strengthening government legislative review, the Ministry of Justice will further improve the government legislative review system and mechanism, innovate government legislative review methods and methods, comprehensively improve the quality and effectiveness of review, and continuously improve the quality and efficiency of legislation. In strengthening the coordination and supervision of administrative law enforcement, the Ministry of Justice will improve the supervision system, innovate supervision methods, strengthen comprehensive coordination, and accelerate the realization of all-round, full-process, normalized and long-term supervision of administrative law enforcement work. At the same time, the Ministry of Justice will further improve the administrative review system and mechanism.

"We attach great importance to giving full play to the institutional advantages of administrative reconsideration that is fair, efficient, convenient for the people, and its role as the main channel for resolving administrative disputes, especially strengthening the work of administrative reconsideration involving business entities. Last year, administrative review agencies at all levels across the country received 385,000 new cases, a year-on-year increase of 42.7%, of which 2764 were cases in the ecological and environmental field. Throughout the year, 39800 administrative review cases were handled by various business entities, saving 10.39 billion yuan in economic losses for business entities and playing an important role in ensuring high-quality development in services."
